1. Acceptance of Terms

By downloading, installing, or using Doggo Catto Diary (the "App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. Doggo Catto Diary reserves the right to update or modify these Terms at any time without prior notice. Continued use of the App after such modifications constitutes your acceptance of the updated Terms.

2. Use of the App

2.1 License: Doggo Catto Diary grants you a non-exclusive, revocable, non-transferable license to use the App for personal, non-commercial purposes.

2.2 User Conduct: You agree not to engage in any activity that may interfere with or disrupt the functionality of the App, including but not limited to hacking, reverse engineering, or attempting to gain unauthorized access to the App.

3. Subscriptions

3.1 Subscription Plans: Doggo Catto Diary offers a subscription service available in plans: weekly, monthly, and yearly. Prices vary per country and may change over time. Check the price in the app.

3.2 Benefits: By subscribing to the app, users gain access to the following benefits: (1) Add your pets to the app, (2) Post diary logs of pets with texts and photos, (3) Track pet weight, (4) Add pet vaccinations, (5) Set calendar reminders for pet events like grooming and vet visits, all without ads.

3.3 Billing and Payment: Subscriptions will be billed either monthly or annually, depending on the chosen plan. Payments will be processed through the app store from which the App was downloaded. Subscriptions will automatically renew unless canceled at least 24 hours before the renewal date.

3.4 Cancellation and Refunds: You may cancel your subscription at any time through your account settings in the App Store for iOS users and Google Play for Android users. No refunds will be provided for any unused portion of the subscription term.

4. User Content and Intellectual Property

4.1 Ownership: You retain full ownership of all content you upload to the App, including but not limited to pet photos, diary entries, and other user-generated content ("User Content").

4.2 License to Doggo Catto Diary: By uploading User Content, you grant Doggo Catto Diary a non-exclusive, royalty-free, worldwide license to store, display, and process your User Content solely for the purpose of providing and improving the App's services to you.

4.3 Content Responsibility: You are solely responsible for the User Content you upload and represent that you have the necessary rights to share such content.

5. Prohibited Content

You agree not to upload, post, or share any content that: (a) is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable; (b) infringes on any third party's intellectual property or privacy rights; (c) contains viruses, malware, or any other harmful code; (d) is fraudulent or deceptive; or (e) violates any applicable local, national, or international law.

6. Account Termination

6.1 Termination by User: You may delete your account at any time through the App settings or by contacting us at the email address provided below.

6.2 Termination by Doggo Catto Diary: We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms of Service, is harmful to other users, or is otherwise inappropriate.

7. Account and Data Deletion

You may request deletion of your account and all associated data by contacting us at the email address provided below or through the account deletion feature in the App. Upon receiving your request, we will delete your personal data in accordance with applicable data protection laws, typically within 30 days, unless we are required to retain certain information for legal or legitimate business purposes.

8. Data Collection and Privacy

8.1 User Sign-In: The App offers user sign-in options through Google Sign-in and Apple Sign-in. By signing in using these methods, you consent to the collection and use of your provided information as outlined in these Terms of Service and the Privacy Policy.

8.2 Information Collected: Doggo Catto Diary may collect non-sensitive personal information such as your email address (provided by Google or Apple), display name (optional), and region (optional).

8.3 Usage of Collected Information: The collected information may be used for account creation, communication related to your account, providing personalized content, and improving user experience within the App.

8.4 Third-Party Services: The App may utilize third-party analytics services. Your use of these services is subject to their respective privacy policies.

9. Data Privacy and Security

9.1 Data Security: Doggo Catto Diary is committed to protecting your data and will handle it securely in accordance with applicable data protection laws.

9.2 No Sensitive Information: Doggo Catto Diary does not collect sensitive personal information, such as financial data or personally identifiable information beyond what is necessary for app functionality.

10. Medical and Health Disclaimer

The App is designed to help you track and organize information about your pets. The App does not provide veterinary advice, diagnosis, or treatment. Any health-related features, including vaccination tracking and weight monitoring, are for informational and organizational purposes only. Always consult a qualified veterinarian for any health concerns regarding your pets. Doggo Catto Diary is not responsible for any decisions made based on information stored or displayed in the App.

11. Updates and Changes

Doggo Catto Diary may release updates, modifications, or new features for the App. Continued use of the App after such updates constitutes your acceptance of the changes.

12. Disclaimer of Warranty

The App is provided "as is" without any warranty, and Doggo Catto Diary disclaims all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

In no event shall Doggo Catto Diary or its developer be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App.

14. Indemnification

You agree to indemnify, defend, and hold harmless Doggo Catto Diary and its developer, Friedrich Fort Nicolas, from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the App, your User Content, or your violation of these Terms of Service.

15. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Philippines, and users agree to submit to the exclusive jurisdiction of the courts in that jurisdiction.
